SUPPLEMENTAL TERMS OF USE FOR CANADA

1.      Applicability

These Supplemental Terms of Use supplement our main Terms of Use and applies only to residents of Canada.  They also include additional rights and obligations for customers located in Québec. If there is any conflict between our main Terms & Conditions and this supplement, this supplement will apply for Canadian customers.

2.      Language

In accordance with Québec law, this agreement and related documents are also available in French. [hyperlink – translation in French]

3.      Pricing & Taxes

All prices displayed on our website are shown in United States Dollars.  Canadian customers are responsible for paying all applicable federal and provincial sales taxes, including Goods and Services Tax (GST), Harmonized Sales Tax (HST), Provincial Sales Tax (PST), and/or Quebec Sales Tax (QST), depending on their province of residence. Taxes will be calculated at checkout.

4.      Returns, Refunds, and Warranties

5.      Limitations of Liability

Some parts of our Terms may limit our responsibility for certain issues. However:

  • These limitations may not apply to Canadian customers where local laws prevent it.
  • In Québec, we cannot exclude or limit liability for damages caused by our own acts or gross negligence, or bodily harm or injury.
  • To the fullest extent permitted by law, our liability remains limited as described in the main Terms, except where prohibited by Canadian or Québec law.

6.      Governing Law & Jurisdiction

  • For Canadian customers outside Québec: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada.
  • For Québec customers: These Terms are governed by the laws of the Province of Québec and the federal laws of Canada.
  • Québec consumers may bring any dispute before the courts of Québec.

7.       Language Preference Clause

The Consumer confirms that it has reviewed the French version of this Agreement and that it has expressly requested that this Agreement and all notices, documents and instruments in connection therewith be written in English or English and French. Le Consommateur confirme qu’il a pris connaissance de la version française de la présente Convention et qu’il a expressément demandé que la présente Convention et tous avis, documents ou actes y afférent soient rédigés en anglais seulement ou à la fois en anglais et en français.
